Introduction. Welcome to www.freeified.com (“Freeified"). Thanks for stopping by. By accessing Freeified you are agreeing to the following terms, which are designed to make sure that Freeified works for everyone. This policy is effective as of the 25th of March 2007.

Using Freeified. You will post in the appropriate category or area and will not do any of the following bad things:

violate any laws or our Prohibited Content Policy;
be false or misleading;
infringe any third-party right;
distribute or contain spam, chain letters, or pyramid schemes;
distribute viruses or any other technologies that may harm Freeified or the interests or property of Freeified users;
impose an unreasonable load on our infrastructure or interfere with the proper working of Freeified;
copy, modify, or distribute any other person's content;
harvest or otherwise collect information about others, including email addresses, without their consent;
bypass measures used to prevent or restrict access to Freeified.

Abusing Freeified. Please use the tagging system to tell us about any problems or offensive content so that together we can keep the site working properly. We may limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Freeified if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Freeified or not, we do not accept any liability for monitoring Freeified or for unauthorized or unlawful content on Freeified or use of Freeified by users.

Fees and Services. Using Freeified is free, but we sometimes charge a fee for some of our services. Our fees are quoted in US Dollars, and we may change them from time to time. Our fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).

Content. Freeified contains stuff from us, you, and other users. You agree not to copy, modify, or distribute Freeified, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe that your rights have been violated, please notify our designated copyright agent at Freeified and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party’s rights.

Liability. You agree not to hold us responsible for things other users post or do. As most of the stuff on Freeified comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Freeified, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 USD.

Personal Information. By using Freeified, you agree to the collection, transfer, storage and use of your personal information by The Freeified Network. (the "data controller") on servers located in the United States, and in the European Union as further described in our privacy policy . You also agree to receive marketing communications from us unless you tell us that you prefer not receive such communications.

General. These terms and the other policies posted on Freeified constitute the entire agreement between The Freeified Network and you, superseding any prior agreements. This agreement is governed by the laws of the United States of America. If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below. Except for notices relating to illegal or infringing content, your notices to us must be sent by registered mail to The Freeified Network, 487 Gross Road, Bailey, Colorado 80421, United States of America. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. We may update this agreement at any time, with updates taking effect when you next post or after 30 days, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us. Send questions, comments or complaints to Freeified Customer Service.

Freeified Policies

The following activities are prohibited from The Freeified Network:

Posting an Ad if you are not located in the area you are posting.
Posting an item for sale that is
Posting multiple Ads that are too similar to each other
Posting an Ad that serves no other purpose than to send traffic to another web site
Posting an Ad that defames anyone or contains "hate speech"
Posting a multi-level marketing or other prohibited job
Posting pornography, nudity or other prohibited personal

Any Ads or users that do not comply with The Freeified Network policy will be removed and blocked from the site.

Our general rule is that you may not list, buy or sell items or services that are illegal to own, buy or sell in your state of residence, or that are not bought or sold in compliance with applicable laws and regulations

IMPORTANT: YOU ARE RESPONSIBLE FOR ENSURING COMPLIANCE WITH ALL APPLICABLE LAWS RELATING TO THE ITEM YOU LIST, BUY OR SELL ON THIS SITE.

We specifically prohibit the following items:

Alcoholic Beverages
Baby Walkers
Blood, Bodily Fluids and Body Parts
Burglary Tools
Counterfeit currency, stamps or coins
Counterfeit Products
Electronic Surveillance Equipment
Embargoed Goods
Escort services that offer or indicate sexual services
Government and Transit Uniforms, IDs and Licenses
Illegal Drugs & Drug Paraphernalia
Illegal Services
Hazardous Materials
Fireworks, Destructive Devices and Explosives
Identity Documents, Personal Financial Records & Personal Information (in any form, including mailing lists)
Items which encourage or facilitate illegal activity
Lottery Tickets, Sweepstakes Entries and Slot Machines
Obscene Material and Child Pornography
Offensive Material
Pesticides
Pictures or images that contain nudity
Police Badges and Uniforms
Prescription Drugs and Devices
Prostitution or ads that offer sex, sexual favours or sexual actions in exchange for money
Recalled items
ROM cards including ROM 102 & ROM 103
Satellite products that violate the Radiocommunication Act
Solicitation of other users except by placing an Ad
Stocks and Other Securities
Stolen Property
Tobacco Products
Used Cosmetics
Weapons and related items (such as firearms, firearm parts and magazines, ammunition, BB and pellet guns, tear gas, stun guns, switchblade knives, and martial arts weapons)

The following types of Pet ads are prohibited on the site:

The Animal Pedigree Act makes it a federal offence to sell an animal of a recognized breed as purebred, registered or eligible to be registered if it is not.
Any Ad that violates the Animal Pedigree Act

The following types of Job ads are prohibited on the site:

Multi-level marketing or pyramid schemes
Business or job opportunities that require upfront or periodic payments
Business or job opportunities that pay only commissions, unless the Ad makes it clear that the sole source of compensation would be commission and clearly describes the product or service that would be sold
Business or job opportunities that require recruitment of other members, distributors or agents
Ads that are not clear regarding what type of work would be required

The following types of Personal or Erotic Service ads are prohibited on the site:

Ads that ask for sex from under age persons
Ads that offer sex or sexual activities in exchange for money, products or services
Ads that contain bestiality
Ads that contain sadistic or masochistic abuse
Ads posted by Men in the "Women seeking Women" category
Ads posted by Men in the "Women seeking Men" category
Ads posted by Women in the "Men seeking Men" category
Ads posted by Women in the "Men seeking Women" category

The following types of items are generally permitted to be listed if and to the extent that their sale and purchase is legally permitted in your State of residence, and that such sales and purchases occur in compliance with applicable laws and regulations:

Electronic Equipment
Event Tickets
Food Items
Non-prescription Medical Devices
Real Estate and Rental Properties
Used Clothing and Bedding
Vehicles, Vehicle Equipment and Devices

Other Posting Policies:

You can post up to 25 different ads per day on The Freeified network. Duplicate ads or ads that are too similar to an existing Ad that you have posted can be posted in two (2) different categories per site within your State. Any more than two and your ads will be removed. We also ask that you not post outside the State you are located in. If you violate these policies your ads will be deleted (sometimes without notice). Attempting to post after having your ads removed may result in a "blocked" message notifying you that you have posted too many ads. To avoid this, please list whatever you are advertising only once per site within your State. If you want to re-list an item that you are already advertising on the site, delete your existing Ad first.

Posting a listing with a link to another web site for the sole purpose of directing visitors to that web site is not permitted. You may, however, include a link in your post if it is to give the user more information about the item being offered (for example product details, pictures, etc.).

You are not permitted to defame anyone or include "hate speech" directed at individuals or groups in your postings. Freeified reserves the right to delete any Ads from the site that are deemed to negatively impact the community. If you encounter any such Ads, please tag it as such.
